Terms and conditions for digital content

Draft – to be reviewed before publication.

This is a translation provided for convenience. Only the German version is legally binding: Deutsche Fassung.

§ 1 Scope, provider, delivery area

These terms apply to all orders for digital content placed via this website between Lukas-Domenik Sonnenfeld, Anschrift siehe Impressum (“we”) and consumers and businesses (“you”). Conflicting terms only apply if we agree to them in writing. We supply customers in the member states of the European Union, Norway, Iceland, Liechtenstein, Switzerland, the USA and Canada, and businesses in the United Kingdom; we do not supply consumers in the United Kingdom.

§ 2 Subject matter

We supply digital content (templates, slides, spreadsheets as files in a ZIP file) as described on the relevant product page. The content is in German. It is a practical aid; it is not legal advice and not an assessment or certification by us.

§ 3 Conclusion of the contract

The presentation of the products is not a binding offer. By clicking one of the payment buttons “Order with obligation to pay – PayPal” or “Order with obligation to pay – card, Apple Pay, Google Pay, Klarna, SEPA & more” and sending the prepared order email, you submit a binding offer. We accept it by sending you an order confirmation by email, at the latest by sending you the download link. We do not store the contract text in a publicly accessible form; you receive the contract details and these terms with the order confirmation. The language of the contract is German; this English text is a translation.

§ 4 Prices and payment

The prices at the time of the order apply. All prices are final prices; VAT exempt under § 19 German VAT Act (UStG) – no VAT is charged. There are no shipping costs. Payment is made in euros, at your choice, via PayPal or via the payment service Stripe (Stripe Payments Europe, Ltd., Dublin) using the payment methods offered there, e.g. card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit. If you pay via Stripe, you enter your payment details only on Stripe’s payment page. The purchase price is due immediately upon ordering.

§ 5 Delivery

Once payment has been received, we send a download link to the email address you ordered from, usually within 2 working days. The link is valid for at least 30 days. Please save the files.

§ 6 Licence

You receive a simple, unlimited-term, non-transferable licence for one company or organisation, including all employees and sites; as a consumer, for your own use. You may edit the content and use it internally as often as you like. Reselling, making it publicly available and using it with your own clients are not permitted. The details are set out in the file LIZENZ.txt.

§ 7 Warranty

The statutory rules on liability for defects apply, for consumers in particular §§ 327 et seq. BGB (German Civil Code). We provide updates where they are necessary to keep the content in conformity with the contract; the content reflects the legal position stated on the product page.

§ 8 Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and under the German Product Liability Act. In cases of slight negligence, we are only liable for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Applying the content to your individual situation and any legal review are your responsibility.

§ 9 Right of withdrawal

Consumers have a right of withdrawal as set out in the information on the right of withdrawal. It expires early if you have expressly agreed that we begin performance before the withdrawal period ends, you have confirmed your awareness that you thereby lose your right of withdrawal, and we have sent you a confirmation of the contract (§ 356(5) BGB).

§ 10 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they habitually reside.
